The judicial stamp duty is the court fee paid to the Romanian state to have a claim heard. For monetary claims (debt recovery, damages, contractual claims) it is calculated in percentage brackets of the claim value under art. 3 of Government Emergency Ordinance no. 80/2013.
On appeal and second appeal, as a rule, 50 % of the first-instance fee is due for the part of the judgment being challenged.
Some claims have fixed fees or special rules (divorce, partition, enforcement objections, small claims), and litigants with low income may apply for legal aid (exemption, reduction or instalments).
